An uncontested divorce is the quickest and least stressful way to end a marriage — provided the spouses agree on the key issues.
Mandatory counselling
Spouses with minor children must first complete mandatory counselling at the social welfare centre, followed by a first family mediation meeting. Only with certificates of both completed procedures can a joint petition for divorce be filed with the court.
The joint parenting plan
The key document is the joint parenting plan: where the child will live, how contact with the other parent will be organised and the amount of child maintenance. A well-drafted plan prevents future disputes — which is why it deserves careful, non-template drafting.
How long it takes
With complete documentation and an agreed plan, an uncontested divorce is normally concluded within a few months. Contested divorces, especially those involving custody and marital property, take considerably longer.
